Georgia Man’s Execution Stayed for 90 Days

17.07.07

Today the State of Georgia Parole Board issued a stay of execution for Troy Anthony Davis convicted of murdering Police Officer Mark Allen McPhail almost 20 years ago. The case, built solely on testimony from witnesses, raised concerns that Georgia was about to execute an innocent man. After 16 years on death row, many of the witnesses that formed the foundation of the prosecutor’s case have since recanted their testimony. Some of these witnesses have explained their reasons for testifying against Troy Davis as reactions to “a lot of pressure” by police.

After a day-long hearing, the parole board said that they refused to put any prisoner to death if there was any doubt that they were guilty. Although this is only a temporary stay and Davis is still in danger of being executed, his family and friends were delighted to hear the news, "Of course we're disappointed that it wasn't full clemency, but I think the reaction of the board shows that there was, in fact, some doubt," explained Danielle Garten, one of Davis' lawyers. This 90 day period will allow Davis’ lawyers to begin a further investigation into the case.
